Use of windrushtri.co.uk, clubhouse.windrushtri.co.uk, myclubhouse.windrushtri.co.uk, and the Official Club WhatsApp groups.
These Terms and Conditions shall apply to your use of the websites: clubhouse.windrushtri.co.uk, myclubhouse.windrushtri.co.uk and windrushtri.co.uk the ‘WindrushTri Websites’; and the WhatsApp groups listed here the ‘WindrushTri WhatsApp Groups’. Collectively the WindrushTri Websites and WindrushTri WhatsApp Groups are referred to as the ‘WindrushTri Sites’.
By using any of the WindrushTri Sites you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you may not use any of the WindrushTri Sites.

Though we endeavour to ensure the accuracy of the information placed on the WindrushTri Sites we do not warrant or guarantee the accuracy or correctness of such information or of any other content, description or material placed on or referred to on the WindrushTri Sites. We do not warrant that the WindrushTri Sites, its content or the servers that makes them available are error or virus free or free of other harmful components or that your use of the WindrushTri Sites will be uninterrupted.
In no event will we be liable for any loss or damage (whether direct or indirect, including loss of profits or any consequential loss) resulting from or in any way connected with your use of the WindrushTri Sites whether caused by negligence or otherwise.
Registration and continued use
1.1 When completing the site registrations you indicate acceptance of all the terms and conditions. You should therefore read all the terms and conditions before registering. You are permitted to place information on the WindrushTri Sites only if you accept all of the terms and conditions set out below.
1.2 When registering with the WindrushTri Sites you will be given the choice to opt in to:
receive the Windrush Triathlon Club marketing emails, such as the Club Newsletters, and to be added to the mailing list, and
receive information from third-parties Windrush Triathlon Club consider appropriate.
1.3 You must provide accurate, current and complete information when registering on the WindrushTri Sites.
1.4 Windrush Triathlon Club reserves the right to change, modify, add or delete sections of these terms and conditions at any time without notice. It is your responsibility to regularly check these terms and conditions and review any changes and/or amendments.
1.5 Your continued use of the WindrushTri Sites after such changes will constitute your acceptance of the new terms and conditions.
1.6 Any training tokens purchased via myclubhouse.windrushtri.co.uk are non-refundable.
Acceptable use
2.1 You must not post or transmit through the WindrushTri Sites any defamatory, threatening, obscene, harmful or pornographic material or material which would violate or infringe in any way upon the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience or which do not comply with all relevant laws. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. Always treat other users with respect.
2.2 You shall not post or otherwise make available on the WindrushTri Sites any material which you do not own without the express permission of the owner of the material.
2.3 Any posted comments by you on Windrush Triathlon Club social media feeds, for example Facebook, Instagram, Twitter and YouTube, are subject to the same high standards detailed herein.
2.4 You may not copy, download, reproduce, republish, broadcast, transmit in any manner whatsoever, any material on the WindrushTri Sites except as is strictly necessary for your own personal non-commercial home use.
2.5 We cannot guarantee anonymity if you do not abide by these terms and conditions or post anything illegal onto the site.
Third party websites
3.1 You acknowledge and agree that Windrush Triathlon Club is not responsible for the availability of any third party Websites or material you access through the WindrushTri Sites, and do not endorse and are not responsible or liable for any content, advertising, products or services on or available from such websites or material, nor for any damage, loss or offence caused, or alleged to be caused, by or in connection with use of or reliance on any content, advertising, products or services available on or available from such Websites or material.
3.2 Any dealings between you and any advertisers or merchants found on or via the WindrushTri Sites, including payment for and delivery of products, services and any other terms, conditions, warranties or representations, associated with such dealings, are solely between you and the relevant advertiser or merchant. You agree not to hold Windrush Triathlon Club liable for any loss or damage of any kind incurred as the result of any such dealings.
Intellectual property
4.1 All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the WindrushTri Sites shall remain at all times vested in Windrush Triathlon Club. You are permitted to use this material or content only as expressly authorised in writing by us and agree not to assist or facilitate any third party to copy, reproduce, transmit, distribute, commercially exploit or create derivative works of such material or content.
4.2 If you become aware of any such distribution or commercial exploitation, you agree to notify us immediately.
Privacy
5.1 By using this site you agree to adhere to the terms and conditions outlined herein the Windrush Triathlon Club Privacy Policy.
5.2 We shall comply with applicable UK Data Protection legislation from time to time in place in respect of any personal information relating to you gathered by us.
5.3 You may be asked to input various basic information about yourself on different pages of the WindrushTri Sites. We will not use the information given for any purpose unconnected with Windrush Triathlon Club or as set out in our Privacy Policy which sets out further information about our use of User Information.
5.4 Please notify us of any changes to the information you have previously given or if you wish to withdraw your consent to our using the User Information for the stated purposes or for any form of promotional contact.

Indemnity
You agree to indemnify Windrush Triathlon Club, the committee members and Windrush Triathlon Club coaches immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the WindrushTri Sites.
Termination
We shall have the right immediately to terminate your use of the WindrushTri Sites if we determine in our sole discretion that you have breached these terms and conditions or otherwise been engaged in conduct which we determine in our sole discretion to be unacceptable.
BTF policies
These Policies shall apply to all members of Windrush Triathlon Club (‘the Club’).
Safeguarding
The Club recognises the need to ensure the welfare and safety of all people engaged in the sport of triathlon. As part of the Club’s commitment to ensure this safety the Club agrees to follow the British Triathlon Federation (BTF) Safeguarding Policy (dated March 2021).
